Terms of Service

By accessing opengolin.ai or downloading, installing, or using the OpenGolin.AI software, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

Subject to your compliance with these terms and payment of the applicable license fee, OpenGolin.AI grants you a non-exclusive, non-transferable, non-sublicensable license to:

• Install and use the OpenGolin.AI software on the number of servers permitted by your plan.
• Access updates and new versions released during your license period.
• Use the software for your internal business operations.

You may not:

• Redistribute, resell, sublicense, or transfer the software or your license key to any third party without prior written consent.
• Use a single license on more servers than permitted by your plan tier.
• Reverse engineer, decompile, or disassemble the compiled portions of the software beyond what is expressly permitted by applicable law.
• Remove or alter any proprietary notices, labels, or marks on the software.
• Use the software for any unlawful purpose or in violation of any applicable laws or regulations.

Licenses are annual. Your license entitles you to software updates and support for one year from the date of purchase. Upon expiry, the software will continue to function but you will no longer receive updates or support. You may renew at any time to restore update access and receive a new download token.

The Free license is provided “as-is” with community-only support. OpenGolin.AI reserves the right to modify, restrict, or discontinue the Free tier at any time with reasonable notice.

All payments are processed securely by Stripe. Prices are listed in Euros (EUR) and exclude any applicable local taxes (VAT, GST, etc.), which may be added at checkout depending on your jurisdiction.

Due to the digital nature of the product (a license key and download link delivered immediately upon purchase), refunds are not available once a license key has been issued and the download token has been used. If you experience a technical issue preventing installation, contact us within 14 days and we will work to resolve it.

All data processed by the OpenGolin.AI software running on your infrastructure remains entirely within your control. We have no access to your data, AI conversations, database contents, or documents. Our Privacy Policy governs the limited personal data we collect in relation to account management and website analytics.

The OpenGolin.AI software, brand, name, logo, and all associated intellectual property are owned by or licensed to OpenGolin.AI. These Terms do not transfer any ownership rights to you. Open-source components included in the software are subject to their respective licenses (MIT, Apache 2.0, etc.) as documented in the software.

The software is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the software will be error-free or uninterrupted.

To the maximum extent permitted by applicable law, OpenGolin.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the software, even if we have been advised of the possibility of such damages. Our total cumulative liability shall not exceed the amount paid by you for the license in the 12 months preceding the claim.

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Portugal.

We reserve the right to modify these Terms at any time. We will notify registered users by email of material changes. Continued use of the software or website after such changes constitutes your acceptance of the updated Terms.
